Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website shihanskinpro.com (the "Site") and the products and services offered through it by Shihan Beauty Clinic LLC, a Connecticut limited liability company located at 304 W Main Street, Avon, CT 06001 ("Shihan Beauty Clinic," "we," "us," or "our"). By accessing the Site, booking a service, or purchasing a product, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site.

1. Who can use the Site

You must be at least 18 years old to purchase products, book services, or create an account. By using the Site you represent that you are of legal age and have the legal capacity to enter into this agreement.

2. Services vs. products

The Site supports two separate offerings:

• In-clinic services (permanent makeup, microblading, HydraFacial, microneedling, threading, paramedical micropigmentation, and related services) are scheduled and paid through our third-party booking partner, Vagaro, and performed at our Avon, CT studio. Service bookings are also subject to Vagaro's terms and our in-clinic policies, which are presented to you before your appointment.
• Products (skincare, aftercare, and other retail items) sold through the Site are shipped to U.S. addresses only and are governed by our Refund Policy and Shipping Policy.

3. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at shihanfarzinzad@gmail.com if you suspect unauthorized use.

4. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law;
• Impersonate another person or misrepresent your affiliation with a person or entity;
• Interfere with, disable, or attempt to gain unauthorized access to the Site or its underlying systems;
• Scrape, harvest, or republish content from the Site without our prior written permission;
• Upload viruses, malware, or any code intended to disrupt the Site;
• Use the Site to harass, defame, or harm any person.

5. Products and orders

Order acceptance. Placing an order is an offer to buy, not a binding contract. We may decline or cancel any order — for example, if a product is out of stock, if pricing was listed in error, or if we suspect fraud.

Pricing and availability. Prices are listed in U.S. dollars and may change without notice. We are not bound by typographical errors. If a pricing error is discovered after you place an order, we will contact you and offer the choice to confirm at the corrected price or cancel for a full refund.

Color and photo accuracy. We make every effort to display product colors and packaging accurately, but actual colors may vary based on your monitor or device settings. Variations in color or packaging are not a defect.

Taxes. Connecticut sales tax is applied where required. You are responsible for any other taxes or duties.

Payment. Payments are processed by Shopify Payments and other approved processors. We do not store your full card number.

6. Service appointments — booking, cancellation, and conduct

Bookings made through Vagaro are subject to the cancellation and no-show terms presented during checkout. In summary:

• Cancellation window: 24 hours' notice required to avoid a cancellation fee.
• No-shows and same-day cancellations may forfeit any deposit and may be charged up to 50% of the service price.
• Late arrivals of more than 15 minutes may be rescheduled and may forfeit any deposit.
• Touch-ups for permanent makeup services are governed by our in-clinic policy provided at your appointment and are not a substitute for refunds.

You agree to disclose accurate health and skin history at intake. Falsifying intake information may result in service refusal without refund and releases us from related liability.

7. Gift cards and promotional codes

Gift cards. Gift cards purchased from Shihan Beauty Clinic are non-refundable except where required by law. In compliance with Connecticut General Statutes § 42-460, gift cards sold by Shihan Beauty Clinic do not expire, and any remaining balance under $5 may be redeemed in cash upon request. Gift cards cannot be replaced if lost or stolen unless purchased through an account where the card was registered.

Promotional codes. Discount and promotional codes are single-use unless otherwise stated, have no cash value, cannot be combined with other offers, cannot be applied to prior purchases, and may be revoked or modified at any time.

8. SMS and email communications

Transactional messages. By placing an order or booking a service, you consent to receive transactional messages (order confirmations, shipping updates, appointment reminders) by email or SMS to the contact information you provide.

Marketing messages. If you opt in to marketing SMS or email, message and data rates may apply for SMS. Marketing frequency varies. Reply STOP to any SMS to unsubscribe and HELP for help. Unsubscribe from marketing email using the link in any marketing email we send. Opting out of marketing does not stop transactional messages tied to an order or appointment.

Electronic communications. By using the Site you consent to receive communications from us electronically, including emails, in-Site notices, and SMS where you have provided a number. Electronic communications satisfy any legal requirement that the communication be in writing.

9. Intellectual property

All content on the Site — including the "Shihan Beauty Clinic" name, logos, photography of work, copy, page layouts, and training materials — is owned by Shihan Beauty Clinic LLC or used under license, and is protected by U.S. and international copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. Limited personal, non-commercial browsing is permitted.

10. Reviews and user submissions

If you submit reviews, photos, testimonials, or other content to the Site or to our social media channels, you grant Shihan Beauty Clinic a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in marketing materials. You represent that the content is your original work and does not infringe anyone's rights.

11. Copyright complaints (DMCA)

We respect the intellectual property rights of others. If you believe content on the Site infringes your copyright, please send a written notice to shihanfarzinzad@gmail.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material that is claimed to be infringing and its location on the Site; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

12. Medical disclaimer — informational content only

The Site provides general information about beauty and aesthetic services. It is not medical advice. Permanent makeup, microneedling, and related procedures carry risks including but not limited to allergic reaction, pigment migration, infection, scarring, and outcomes that vary by skin type, medications, and aftercare adherence. Specific advice for your situation must come from a qualified practitioner during an in-person consultation. Do not rely on Site content to diagnose or treat any condition.

13. Results not guaranteed

Permanent makeup, microblading, aesthetic procedures, and skincare product results vary by individual. Examples and testimonials reflect individual results and are not a representation that you will achieve the same outcome.

14. Third-party services and links

The Site links to and integrates with third-party services including Vagaro (booking), Shopify (e-commerce platform and payments), Instagram, Facebook, Yelp, and Google. We are not responsible for the content, terms, or privacy practices of any third party. Your use of those services is governed by the third party's own terms.

15. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY CONNECTICUT LAW, Shihan Beauty Clinic LLC, ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law, including for gross negligence, willful misconduct, or personal injury caused by us in the course of providing in-clinic services.

17. Indemnification

You agree to indemnify and hold harmless Shihan Beauty Clinic LLC and its owners, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any rights of a third party.

18. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, supply-chain failures, carrier delays, pandemics, internet outages, or utility failures.

19. Governing law and venue

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Hartford County, Connecticut, and you consent to the personal jurisdiction of those courts.

20. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted on the Site. Continued use of the Site after a change constitutes acceptance.

21. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.

22. Entire agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Shihan Beauty Clinic LLC regarding the Site and supersede all prior agreements.
